Terms and Conditions of Service

Please read these Terms of Use (“Terms”) carefully before using the CosmoHub mobile application (“App”) and associated services (“Service”) operated by the Provider, Olena Kysylychka (“we,” “us,” or “our”). These Terms govern your access to and use of the Service and form a legally binding agreement between you (“User”) and the Provider.

1. Eligibility

1.1. You must be at least 13 years old to use the Service. If your country requires parental consent for data collection for minors under a certain age (e.g., 16 in the EU), you may need to provide verified consent.

1.2. By using the Service, you confirm that you meet the age requirement and are legally capable of entering into binding agreements.

2. License

2.1. The Provider grants you a non-exclusive, non-transferable, limited license to use the App in its Basic and Premium versions under these Terms.

2.2. The Basic version is free to use and available indefinitely. You can install and launch the Basic version on your mobile device.

2.3. The Premium version is available on a subscription basis and may begin with a free trial (typically 7 days unless otherwise specified). Continued use requires payment as described in the pricing terms in the App.

2.4. The license to the Premium version is granted upon your order through the App and is subject to these Terms.

2.5. The license can be renewed upon payment unless you cancel it in advance. Your consent to recurring charges implies extension of the agreement.

2.6. Payments are processed using the payment methods available in the App.

3. Account Registration and Security

3.1. You may need to create an account to use certain features. You agree to provide accurate information and keep it updated.

3.2. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

3.3. If you log in using third-party services (Apple, Google, Facebook, Instagram), you acknowledge that we are not responsible for those platforms’ data practices or outages.

4. User Conduct and Restrictions

4.1. You agree not to:

  • Reverse engineer, decompile, disassemble, decrypt, or emulate the App;
  • Copy or reproduce the App or any part of it without prior written consent;
  • Use the App to create derivative software or services;
  • Delete or modify trademarks, copyright notices, or proprietary labels within the App;
  • Use the App in violation of applicable laws or these Terms.

4.2. We reserve the right to set technical and content limitations, including restrictions on certain features.

4.3. The App may change over time, and we may discontinue certain features or services at any time without prior notice.

5. Intellectual Property and Content

5.1. All content provided by the App, including exercises, videos, text, images, and design, is the exclusive property of the Provider or its licensors.

5.2. You may not use, copy, reproduce, or distribute any part of the content without prior written consent.

5.3. If you submit any content (e.g., feedback), you grant the Provider a worldwide, royalty-free, irrevocable license to use it for any purpose.

6. Subscriptions and Payments

6.1. Subscription terms and fees are described within the App. Prices may change, and you will be notified in advance.

6.2. Your subscription may auto-renew unless you cancel it through your App Store settings before the end of the billing period.

6.3. Refunds, if applicable, are handled according to the App Store provider’s policy.

6.4. Refund requests should be addressed to the relevant App Store provider (Apple or Google). CosmoHub does not process direct refunds.

7. Termination

7.1. We reserve the right to suspend or terminate your account or access to the Service if you breach these Terms.

7.2. You may delete your account at any time by using the in-app settings. Some data may be retained for legal or security reasons.

8. Notifications

8.1. You agree to receive in-app notifications from us regarding updates, new features, terms changes, and other information.

8.2. Notifications may also be used for marketing and informational messages unless you opt out.

9. Privacy and Security

9.1. We process your data in accordance with our Privacy Policy. By using the App, you agree to the data practices described therein.

9.2. You are responsible for securing your mobile device. We are not liable for unauthorized access resulting from your negligence.

9.3. We are committed to maintaining the confidentiality of your information unless:

  • It is publicly available;
  • You provide consent to disclose it;
  • Disclosure is required for contractual or legal compliance;
  • It is required by law or law enforcement agencies;
  • Or as specified in our Privacy Policy.

10. Disclaimers and Limitation of Liability

10.1. The Service is provided “as is” without warranties of any kind. We do not guarantee that the App will be error-free or uninterrupted.

10.2. We are not responsible for hardware/software issues beyond our control or damages caused by improper use, malware, third-party access, or unauthorized device modification (e.g., rooting or jailbreak).

10.3. We are not liable for loss of access during scheduled or emergency maintenance or for service changes.

10.4. Any disputes must be resolved through negotiation. If unresolved within 60 days, either party may file a claim in a competent court at the Provider’s location.

11.1. If you believe your copyright or intellectual property rights have been infringed, please contact us at cosmohub.app@gmail.com with sufficient details for evaluation under the DMCA.

12. Dispute Resolution and Arbitration (USA Users)

12.1. For users residing in the United States, any disputes that cannot be resolved informally shall be submitted to binding arbitration on an individual basis. You waive your right to class action lawsuits or jury trials.

12.2. Arbitration will be conducted in accordance with the rules of the American Arbitration Association.

13. Changes to Terms

13.1. We may update these Terms at any time. If changes are material, we will notify you via the App or email. Continued use after changes means acceptance.

14. Governing Law

14.1. These Terms are governed by the laws of Ukraine unless otherwise required by applicable consumer protection laws.

15. End User License Agreement (EULA)

15.1. These Terms of Use function as an End User License Agreement (EULA) between you (the “User”) and the Provider. Under this EULA, you are granted a limited, non-exclusive, non-transferable, and revocable license to install and use the CosmoHub App on a compatible personal device for your own personal, non-commercial use and in accordance with these Terms.

15.2. You agree not to:

  • Copy, modify, or create derivative works based on the App or any part of it;
  • Reverse engineer, decompile, or attempt to extract the source code of the App, except as expressly permitted by applicable law;
  • Rent, lease, sublicense, distribute, or assign the App to any third party;
  • Circumvent any technical restrictions or digital rights management (DRM) built into the App.

15.3. The license does not grant you any ownership rights in the App or its content. All rights not expressly granted to you remain with the Provider.

15.4. Your license to use the App terminates automatically if you breach any of these Terms, or upon account deletion. Upon termination, you must cease all use of the App and uninstall it from your device.
